Serious illness, serious bodily accident or death of the User, first-degree relative, the person designated for the custody of minor and/or disabled children.

Serious damage to the accommodation.

Any other cases that arise suddenly and unpredictably and are unavoidable at the will of the parties. Included in this category are all those situations that, in accordance with what is described in this clause, prevent the Owner from offering his Property for rent and/or the Tenant, Resident from accessing the reserved Accommodation on the scheduled Entry Date.

By way of example, but not limitation, these circumstances may include natural disasters, terrorism, security threats at the location of the Accommodation, epidemics and/or outbreak of a disease, travel restrictions as a result of any of the above circumstances, among others. , whose scope affects the Owner and/or the Tenant, Resident in accordance with what is indicated below.

All these cases will be specifically and individually evaluated by ROOMAWAYS. In the event that the user finds himself in any of these situations, Roomaways reserves the right: (i) to request from him the documentation that, based on the specific circumstances, is deemed pertinent by the Roomaways team; and/or, (ii) where appropriate, to directly authorize the cancellation of the reservation by the affected party without penalty.

Any decision regarding the above situations will always be defined based on the official communications of the relevant authorities at all times.

In the event that the Resident tests positive for COVID before the date of entry, the Tenant, Resident shall have the right to request the postponement of said date of entry until the illness/quarantine ends. Roomaways may request at any time any proof of the aforementioned COVID situation.

In the event that the Tenant, Resident declines the possibility of postponing the aforementioned check-in date, the Roomaways Force Majeure policy will apply only in the following cases:

The Tenant, Resident is not physically located in the country where the reservation will be made and cannot travel due to their positive COVID test, or

New travel bans are adopted advising not to travel in the country of origin of the Tenant, Resident or in the country of destination of the property (if different from the previous one), or

The government of the country where the property is located has ordered a closure that does not allow the Tenant, Resident to move into the property, or

Tenant, Resident is hospitalized due to COVID, or

The Tenant, Resident has received a medical document indicating that they must remain in quarantine for a period greater than 10 days.

For the avoidance of doubt, force majeure will not apply in the following circumstances:

The Resident Tenant is already located in the country where the reservation will be made and there is no confinement in said country that prevents the Resident Tenant from moving into the property.

Resident is in an apartment and a roommate has tested positive for COVID and Resident is asking Roomaways to relocate. For clarity, it is essential to understand that the Roomaways Intermediary digital service has been fully rendered once the Tenant, Resident moved into the property, therefore any circumstance occurring after check-in is not the responsibility of Roomaways. Roomawats. Roomaways will assist the Tenant, Resident mediating with the Owner but in any case the relocation or any other solution will be the exclusive decision of the Owner.
