2. What data do we collect?

2.1 Data provided by you

a) Registration as a tenant, Resident and information necessary to make a reservation request: In order to create a user account, you provide us with your name, surnames and email. If you finally make a reservation request, you also provide us with your date of birth, gender, nationality, identity document or passport, telephone number, and your card or PayPal details (means of payment).

b) Registration as owner and property announcement: In order to create your owner account, through the web, you provide us with your name, surnames, email, telephone, address, identity document or passport, address of the property/s you want to advertise, and your bank details (bank account). If you choose to create the ad yourself, you must also provide photographs and videos of the property(s) you wish to rent. In order to make the invoice in your favor, you must also provide us with your tax identification number and your code postal address if you are a natural person, or your NIF, company name and tax domicile if you are a legal entity.

3. What are we going to use your personal data for?

3.1 For the provision of our services.

a) Manage the creation of your user account as Tenant, Resident and allow you to use or modify it. In order to be able to save your search preferences, receive alerts and make reservation requests, you must have an account and identify yourself as a user.

b) Manage the creation of your user account as Owner and allow you to use or modify it. In order to manage the advertisements of your property(ies) and receive reservation requests, you must have an account and identify yourself as a user.

c) Allow reservation payment through our platform, if you are a tenant, and manage the collection, if you are an owner.

d) Make it easier for both parties to sign the lease through the platform, without complications. For this it is essential that you provide the necessary data.

e) Contact you to give you information regarding a reservation request. These communications may be made by email, telephone or text messages. The form of communication chosen will depend on the reason for the communication.

f) Offer you the best care and assistance. Through our Help Center we offer you assistance at any time for any questions, comments, suggestions or incidents related to the service that you want to ask us. This help can only be provided if we have your personal data.

g) Resolve complaints, help tenants find another property when the reservation request has not been accepted by the owner.

h) Any other issue related to the provision of the service.

3.2 To keep you up to date with our news and promotions.

We will use your Personal Data to send you news, products and promotions related to Roomaways. We periodically launch campaigns, promotions, contests and sweepstakes. In any case, keep in mind that you can unsubscribe from such communications at any time. To do this, you will simply have to click on the "Unsubscribe" link contained in any of the communications.

3.3 To prevent possible fraud.

In order to create an environment of trust for you, at Roomaways, we may use your personal data for the detection and prevention of possible fraud and other illegal or unwanted activities. Similarly, we may use such personal data for risk assessment and security purposes, including user and property authentication. For such purposes, we may need to quarantine certain reservations or reservation requests until we have completed our evaluation.

To the extent permitted by applicable law, we may receive additional information about you from third-party service providers and/or collaborators, and cross-reference it with data we already have. For example, we may verify or authenticate all personally/business identifiable data, such as your first and last name(s), date of birth, mobile phone number, address, ID, etc. To do so, we will perform checks against databases and other sources of information from third parties, such as fraud prevention agencies, telecommunications providers and providers of identity verification solutions. Similarly, we may verify your mobile phone number with your mobile provider to prevent SIM swap fraud and we may verify the authenticity of photos of your properties through third-party providers.

In addition, we use third parties to process payments or provide bill collection services. When a payment question or problem arises related to your reservation on Roomaways, either by you or by the legitimate owner of the means of payment used to make the payment, we need to share certain data from the reservation request with the service provider of payment and/or the pertinent financial institution to manage the request. This may also include a copy of your booking request confirmation or the IP address used to make your booking request and other relevant information. We may also share information with relevant financial institutions if we deem it strictly necessary for fraud detection and prevention.

We also use information about how you use and interact with our website, app or services, including the device you use, for potential fraud prevention purposes. This helps us to control the security of the platform and to control possible fraud, in addition to improving the service you receive from Roomaways.

3.4 To claim unpaid amounts.

In cases of non-payment, the data related to the debt and the user may be communicated to third-party companies specialized in the recovery of unpaid amounts. These third-party companies are duly authorized and will be in charge of managing the breach of monetary obligations. Likewise, companies are contractually obliged to protect your personal information, having access to it to carry out this entrusted task.

3.5 To improve our service.

At Roomaways we are improving the usability of the Website and Application, optimizing it to make it more functional. These jobs often require the use of some of your personal data or data obtained through, for example, Google Analytics.
In addition, through the satisfaction survey and reviews, we analyze what we can improve to provide a better experience and avoid recurring problems or bad experiences.

4. What is the legal basis for these data treatments?

The legal bases that allow us to process your data for each of the purposes indicated in the previous section are:

5. How long will we keep your data?

The data that is necessary for the provision of the service will be kept for as long as it is necessary for this purpose or until you expressly request their deletion. However, they will be kept "blocked" for a period of 6 years at the disposal of the public administration, judges and courts, for the attention and defense of possible responsibilities arising from the treatment.


We may retain some of your personal data to the extent necessary for our legitimate interests, such as detecting and preventing fraud. The data collected for this purpose will be kept blocked for a period of 10 years at the disposal of the public administration, judges and courts, for the attention and defense of possible responsibilities arising from the treatment.


We will use the data used to send you news and promotions until you ask us to stop doing so. Please note that you can ask us to stop sending you personalized news, offers and promotions at any time; you will simply have to click on the “Unsubscribe” link in any of our communications.

6. With whom do we share your data?

6.1 With tenants and owners.

Being able to manage reservation requests and subsequent stays, it is essential that we share personal data with other users of the platform, it will be necessary for the correct fulfillment of your contract with the Owner, as indicated below:


- Each time that, as a Tenant, Resident you send a reservation request, we share certain information about you with the owner, such as your profile (gender, age, study center...) and the documents that prove your identity. Once your reservation, we will share your contact information with the owner.


- Each time that, as the owner, you have a confirmed reservation, we will share with the tenant your full name, contact information and full address of the property to coordinate the reservation.

6.2 With partner companies of ROOMAWAYS.

We need to transfer or allow access to your personal data to different collaborating entities for service reasons.

6.3 With suppliers necessary for the provision of the service. (Taxi Service to Tenant, Resident - Renting of sheets to Owner)

By reason of the service, these providers have limited access to your personal data to carry out certain tasks on our behalf and are obligated by contract to protect it and use it only in accordance with our instructions. To this end, Roomaways has signed the corresponding Treatment Manager contracts and verified that they meet sufficient guarantees to apply appropriate technical and organizational measures, in such a way that the treatment is carried out in accordance with the requirements of the RGPD, guaranteeing the protection of Your rights.


Service providers may help us, for example, with the following:


- Provide customer service.
- Store information securely.
- Send commercial communications.
- To prevent possible fraud.
- To collect and recover debts.
- Verify or authenticate your identity and address.

6.5 Competent authorities.

We will disclose your personal data to government authorities as required by law or strictly necessary for the prevention, detection, or prosecution of criminal acts and fraud, or as otherwise legally required.
